Terms Used

'KSoft', 'KSoft Consultancy' refer to ksoftconsultancy.com website and its Associates or Affiliates.
'We', 'Us' refer to 'KSoft and its Associates or Affiliates'.
'Website', 'Web Application' refers to KSoft and its Associates website and/or its parts.
'You' refers to the visitor/registered user of the Website. It may also include Clients, Associates, Customers, Affiliates of the user if applicable.
'Third Party' refers to entities other than 'You' and our associate/affiliate/group referred as 'We'.
'Generated Code' would refer to the all the code generated by KSoft and its Associates and related services.
'Services' include the facility of Code Generation and the 'Generated Code'.

Summary

Commercial Use of the Generated Code is allowed, subject to the details mentioned below.

Your Responsibilities

a) General

It is your responsibility to make sure that your use of the Services we offer is compliant with laws, rules and regulations applicable to you. Use of our Services in any manner that violates any law, rule or regulation is strictly prohibited.

b) Related to the Generated Code

You are solely responsible for the use and consequences of the Generated Code. You explicitly agree not to make use of Generated Code for any illegal or unauthorised or unethical purpose. You explicitly understand that there are absolutely no warrenties or guarentees about the Generated Code. It is entirely your responsibility to make sure to verify the Generated Code and satisfy yourself about the suitablity the Generated Code before making use of it. Sometimes, we may not be able to deliver Generated Code (typically due to incorrect input) or there may be delays. You understand this risk and explicitly agree not to seek any compensation should such a situation arise.

Limitations of Liabilities

KSoft and its Associates are in no way responsible for any loss or damage to you or your client or anyone arising out of use of the Generated Code. We provide source code only. You are solely responsible for its use and subsequent consequences. KSoft and its Associates or its affiliates have absolutely no liability airisng out of any use of Generated Code. You agree to indemnify and hold us harmless from and against all loss, cost, expense or liability (including reasonable attorney’s fees) arising out of a claim (including intellectual property rights violation claims) by a third party based upon your use of the Generated Code. You understand and agree that KSoft and its Associates or its affiliates cannot be a party to any disputes arising out of the use of the Generated Code.

Licensing

You acknowkledge that we may need to make some changes to your code to make it suitable for our processing and specifically grant us rights to do so. You accept that the Generated Code would be licensed under the MIT License (MIT). If you submit/upload Code Model or Data Model for Code Generation or Customization of Generated Code, you explicitly grant us license to use that model for producing software code (referred to as 'Generated Code'). You understand and agree that the Generated Code is not produced by making changes to your code model and it is NOT derivative of your model. You also explicitly grant us rights to share the model code with other users of KSoft and its Associates and you also grant us rights to share such code with other websites/servcies if necessary as deemed by us. Any user of KSoft and its Associates services may use such a model for his/her/its orders and you explicitly agree that you would have no rights to such code produced for other users eventhough it is based on your model(s).

How We Use Your Account/Profile Information

We do NOT sell your details for monetory considerations. Your information may be shared within our Associate or Affiliate group. We use your email to notify you about your order processing. You may also receive occasional emails about new features, faclities, chages etc related to our services. Please refer to our Privacy Policy for more details.

Other

In case of any ambiguity over the meaning of terms and conditions, the interepretation of KSoft would be final and binding. The terms of services and privacy policy are subject to change without notice. We reserve right to accept or reject an order or account. Everything subject to jusrisdiction of Mumbai.
